  3. User will use the Materials for the intended purpose of marketing and promotions.
  4. User acknowledges that all Materials are used with the permission of BFS.
  5. User agrees that it will make no claim against FSBP and its related entities in connection with the use of the Materials.Further, User will indemnify FSBP and its related entities for any damage FSBP and its related entities incur related to User's use of the Materials and its obligations under this Terms of Use.
  6. User agrees that all rights in the Materials inure to the benefit of BFS.
  7. User agrees that it retains no rights in or to the Materials.
  8. User will not use the Materials outside of their intended purpose as stated in this Terms of Use.
  9. User will in no way disparage, defame, derogate, or otherwise degrade FSBP and its related entities, its products, or the Materials.
  10. User agrees that it is solely responsible for complying with all legal requirements relating to any advertising promotions.
  11. User has read and agrees to abide by all of the rules and regulations set forth in this Terms of Use Any failure to follow said rules and regulations shall require User to immediately cease use of the Materials and, at FSBP's request, either destroy or return any Materials. User shall be liable for any claims and/or damages to FSBP and its related entities.


OTC Model Rule for Adhesives and Sealants

As part of a regional effort to achieve federally mandated standards in the Northeast and Mid-Atlantic regions of the United States, the Ozone Transport Commission (OTC) has developed a Model Rule for Adhesives and Sealants. The provisions of this model rule limit emissions of volatile organic compounds (VOCs) from adhesives, sealants and primers, including those used in roofing applications. The states that are members of the OTC and must comply with the Model Rule for Adhesives and Sealants are CONNECTICUT, DELAWARE, DISTRICT OF COLUMBIA, MAINE, MARYLAND, MASSACHUSETTS, NEW HAMPSHIRE, NEW JERSEY, NEW YORK, PENNSYLVANIA, RHODE ISLAND, VERMONT and VIRGINIA.

The OTC Model Rule requires that adhesives, sealants and primers contain a maximum of 250 g/L of VOC’s. Today, many of the Firestone products we have had for years already comply with the OTC Model Rule or have compliant alternatives. Specific information regarding Firestone’s products which contain VOC’s and the recommended OTC Model Rule compliant alternative is provided below.

Firestone Products with VOC's and the Recommended LVOC Alternative

Through the efforts of both the EPDM Roofing Association (ERA) and Firestone, each of the OTC member states have either agreed to a “phase-in” period for 2009 or delayed implementation until 2010, so that development of solvent-based alternatives can be completed successfully prior to full year OTC Model Rule enforcement. The earliest phase-in period for the OTC member states is May 15th through September 15th, 2009. During this phase-in period, OTC compliant products must be used in OTC member states. Information by state can be found from the links at http://www.otcair.org/state_links.asp.  If work is planned in any of the OTC member states, it is critical to keep abreast of the periods when LVOC products are required for use by the OTC Model Rule.
